People By Heart

Terms of Use

Effective 30 September 2026.

These terms are an agreement between you and People By Heart (“we”, “us”) about the People By Heart app, the website at peoplebyheart.com and the services behind them (together, the “Service”). By creating an account or using the Service you agree to them and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use it

You must be at least 13 years old, and old enough to enter into this agreement where you live. The Service is for your own personal use; you may not use it on behalf of a company or for a business purpose.

2. Your account

You need an account to use the Service, created with an email address and a password or with Sign in with Apple. Keep your password and your devices to yourself; you are responsible for what happens under your account, and we are not responsible for the consequences of your credentials being shared or lost. Tell us at once at support@peoplebyheart.com if you think someone else has used your account. During the testing period an invite code is required to create an account.

3. What the Service is

People By Heart is a private tool for remembering the people in your life. It files what you tell it and hands it back to you. It is currently offered free of charge while it is being tested; there are no subscriptions or in-app purchases. It is a personal memory aid, provided for your information only.

4. Your content

Everything you write, say or add to the Service is yours. You give us only the permission we need to store it, process it as the Privacy Policy describes, and hand it back to you and to anyone you choose to share it with; that permission ends when you delete the content or your account. We claim no other rights in it.

You are responsible for what you keep. You confirm that you have the right to hold what you write, that it does not break the law or anyone's rights, and that you keep it for your own personal, non-commercial memory. The people you write about are not users of the Service and have not agreed to anything; use the Service to be a better friend to them, not to harm them.

5. Acceptable use

You agree not to use the Service:

6. Sharing with others

If you join a household with your partner, the sharing described in the Privacy Policy applies, and what your partner does with what they have seen is between the two of you. If you send your card to someone, do not use it to harass or deceive them; anyone who receives a card can report it to us, and we may withdraw a card or close an account that is abused this way.

7. The AI can be wrong

Notes are read and filed by an AI model, and it sometimes misreads, misattributes or misses things. Every fact shows the words it came from so you can check it, and you can correct anything. The Service is not a source of advice of any kind. Do not rely on it for anything where a mistake would cause harm, and check anything that matters before you act on it.

8. Our intellectual property

The Service itself, including its software, design, name and logo, belongs to us and our licensors. As long as you follow these terms, you may use it for its intended purpose. You may not copy, modify, distribute, sell or otherwise exploit any part of the Service without our written consent.

9. Copyright complaints

Nothing on the Service is public, but if you believe something in it infringes your copyright, write to support@peoplebyheart.com with “Copyright notice” in the subject line, identifying the work, the material and your contact details, with a statement of good-faith belief and of accuracy under penalty of perjury. We will act on valid notices.

10. Your data, and ending things

You can download everything you have said and everything filed from it, pause your account for a time, or delete your account and everything in it, at any time, in the app or on the website. Deletion is immediate and permanent. We may suspend or close an account that breaks these terms; if we do, and it is lawful and safe to do so, we will give you a way to get your data out first. Sections that by their nature should survive the end of this agreement do so.

11. Changes to the Service

The Service is being tested. We may change it, add to it, limit it or stop it, in whole or in part, at any time. If we stop it, we will tell you first and give you a way to export your data. We are not liable for any change, suspension or discontinuance.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT IT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE IT AT YOUR OWN RISK. THIS DOES NOT AFFECT ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER THE LAW THAT APPLIES TO YOU.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS ARE NOT LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OF USE, DATA, REVENUE OR PROFIT, OR FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF FORESEEABLE OR IF WE WERE TOLD THEY WERE POSSIBLE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED US DOLLARS. THESE LIMITS DO NOT APPLY TO LIABILITY FOR OUR GROSS NEGLIGENCE OR WILFUL MISCONDUCT, OR TO ANY LIABILITY THAT CANNOT BE LIMITED UNDER THE LAW THAT APPLIES TO YOU.

14. Indemnification

You agree to defend, indemnify and hold harmless People By Heart, its affiliates, licensors and service providers, and their officers, directors, employees, contractors and agents, from any claims, liabilities, damages, judgments, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these terms, your content, or your use of the Service other than as these terms allow.

15. Governing law and where disputes go

These terms and any dispute arising out of them or the Service are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any suit, action or proceeding arising out of these terms or the Service must be brought exclusively in the federal or state courts located in Harris County, Texas, and you consent to their jurisdiction and venue, although we may bring a claim against you for breach of these terms where you live. Any claim you have arising out of these terms or the Service must be brought within one year after it arises, or it is permanently barred.

16. If you got the app from Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to maintain or support it. If the app fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. We, not Apple, are responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, claims under consumer protection or similar law, and claims that it infringes someone's intellectual property. You confirm that you are not in a country subject to a US government embargo or designated as supporting terrorism, and that you are not on any US government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when you use the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

17. General

If we do not enforce a provision of these terms, that is not a waiver of it. If a court finds any provision invalid or unenforceable, it will be limited to the minimum extent necessary and the rest remains in force. These terms, the Privacy Policy and any notice we show you in the app are the entire agreement between you and us about the Service. You may not transfer this agreement; we may assign it as part of a change of ownership of the Service, subject to the Privacy Policy.

18. Changes to these terms

We may update these terms to reflect changes in the Service, our practices or the law. When we do, the date at the top changes, and if the change matters we will tell you in the app and ask you to agree again. Continuing to use the Service after a change you have been told about means you accept it.
